This Notice applies to text messages sent by or on behalf of Helix Regen to patients and to individuals who have opted in to receive information about Helix Regen’s free educational seminars on regenerative medicine.
This Notice explains how Helix Regen handles mobile phone numbers and related information when we send text messages about our free educational seminars on regenerative medicine and related updates.
This Notice applies to individuals who have directly provided their mobile number to Helix Regen and agreed to receive text messages from Helix Regen.
It may also apply when a participating clinic collects an opt-in that clearly identifies Helix Regen as the sender and describes the Helix Regen messages the individual will receive.
A clinic may not transfer a patient list to Helix Regen for marketing merely because the clinic has collected phone numbers. Any clinic-based opt-in must be specific, clear, and legally sufficient for Helix Regen’s messages.

We do not ask you to send medical information by text. Please do not send diagnoses, symptoms, treatment history, medical records, images, insurance information, or other health information by SMS.
We use mobile information to:
The seminar is free, but messages about the seminar may promote Helix Regen’s services. The SMS program is therefore administered as a promotional or commercial messaging program, not as a substitute for medical care.
We do not sell your mobile phone number or your SMS consent.
We do not share your mobile phone number or SMS consent with third parties or affiliates for their independent marketing or promotional purposes.
We may share mobile information with service providers that help us operate the SMS program, including messaging platforms, telecommunications carriers, technology providers, security vendors, and compliance vendors.
These providers may use the information only to provide services to Helix Regen, subject to contractual confidentiality, security, and data-use restrictions.
If a participating clinic is involved in collecting an opt-in, Helix Regen may maintain the consent record needed to administer the SMS program. A clinic may not provide Helix Regen with a patient list for marketing unless the disclosure and use are separately authorized and legally permitted.
We do not provide participating clinics with your SMS responses, seminar attendance information, treatment information, or other health information unless legally permitted and necessary for a specifically authorized purpose.

If you are a patient, your medical information is governed by the applicable Notice of Privacy Practices and other privacy requirements. This SMS Notice does not replace those documents.
We do not include medical information in seminar text messages.
Do not send medical information by text. SMS may not be encrypted end-to-end and may be viewed by anyone with access to your phone, account, notifications, or messaging application.
If Helix Regen or a participating clinic intends to use or disclose protected health information to identify or contact you for marketing, the clinic or covered entity must obtain any authorization required by HIPAA and applicable law. SMS consent alone does not necessarily authorize the use or disclosure of protected health information for marketing.
You may request a more secure communication method. You may also ask that communications be sent to a different phone number or contact method, subject to applicable law and our ability to accommodate the request.
We retain your mobile number, opt-in record, consent language, delivery records, and consent-related communications for as long as reasonably necessary to administer the SMS program and demonstrate compliance.
Unless a longer period is required by law, litigation hold, regulatory requirement, contractual obligation, or Helix Regen’s records-retention schedule, we intend to retain consent records for at least four years after consent is given or after your last interaction with the SMS program, whichever is later.
If you opt out, we retain a suppression record showing that you opted out. We retain that record so we do not send you future messages. The suppression record is not used to resume marketing contact.
You may opt out at any time by replying STOP to a Helix Regen text message.
You may also contact us using the information in Section 9 and request that texting stop.
After receiving an opt-out request, we will stop consent-based promotional messages and send no more than one confirmation message, if appropriate and technically available. The confirmation will contain no promotional content.
Reply HELP for assistance, or contact us using the information in Section 9.
We will treat clear requests such as QUIT, END, CANCEL, UNSUBSCRIBE, REVOKE, or OPT OUT as requests to stop messages. If you use other words that reasonably communicate that you do not want further messages, we will treat the communication as an opt-out request.
Opting out of SMS will not affect your ability to receive medical care, a candidacy screening, or other services. It will not affect payment, enrollment, eligibility, or any relationship you have with Helix Regen or a participating clinic.
We may contact you by another lawful method if you separately consent to that method or if otherwise permitted by law. You may separately request that we stop other types of contact.
Depending on your state of residence, you may have rights regarding access to, correction of, deletion of, or restriction on the use of certain personal information. Contact us using Section 9 to submit a request.
We use reasonable administrative, technical, and physical safeguards designed to protect mobile information and consent records.
No method of transmission or storage is completely secure. SMS messages may be visible on a lock screen, shared device, carrier system, or messaging application, and may not be encrypted end-to-end.
If we discover a security incident involving information covered by HIPAA, applicable state law, or another breach-notification requirement, we will provide notices as required by law.

We may update this Notice from time to time. The current version will be posted at https://tryhelixregen.com/sms-privacy and will state its effective date.
If we make a material change to how we use or share mobile information, we will provide any notice required by applicable law. We will not use a new purpose to expand previously collected consent without obtaining any additional consent required by law.
We text you only if you agreed to receive Helix Regen messages. We do not sell your mobile number or let other companies use it for their own marketing. Reply STOP to stop texts or HELP for help. Do not send medical information by text.
